Legal requirements in 4 easy steps.
When
you have found the villa, apartment or "rustico"
(country cottage) of your dreams, this is what you need
to do:
1.MAKE
AN OFFER TO PURCHASE IN WRITING (the proposta
di acquisto). It binds you for the offer of price for
a limited period (normally between 7 and 10 days).
The "proposta di acquisto" is a private contract
between buyer and seller; it provides full information
regarding the property, and includes specifications
from the Local Land Registry (the catasto).
2.
A DEPOSIT - Caparra - ( between 10
and 30 % of the agreed price) is payable at this point.
If you subsequently decide not to go ahead with the
purchase, or fail to complete by the agreed date, this
deposit is forfeited.
If
the seller fail to provide details about the property
in accordance with the legal requirements, he is obliged
to repay twice the deposit.
We
can put you in touch with an architect, who will be
responsible for checking the condition of the property.
3.
A PRELIMINARY CONTRACT OF SALE (the
Compromesso) can then be signed.
The Estate Agent's commission is payable at this point,
by both Buyer and Seller.
4.
The "Compromesso" will specify a date for
completion, the final signing of the deed
(the Atto).
This takes place in the presence of a Public Notary
(Notaio), to whom a fee is also due. His function is
to witness the contract, to collect the land registry
tax from the buyer, and to obtain the various bolli
(official stamps) required to legalise the documents.
